By accessing or using the Service at aivideorecap.com (the "Website"), you ("User") agree to be bound by these Terms of Service (the "Terms"). If you do not agree, do not use the Service.

Nature of the Service

AI Video Recap is a technical tool that automatically processes user-supplied video and audio files using artificial intelligence algorithms, including speech recognition, scene analysis, script generation, voice synthesis, audio mixing, and video editing.

The Service is NOT:

  • A content distribution platform
  • A video download or hosting service for third-party content
  • A guarantor of AI output accuracy
  • A substitute for professional video editing or copyright clearance

User Responsibility

The User is solely and exclusively responsible for:

2.1

Compliance with copyright, neighboring rights, and all other intellectual property rights relating to uploaded and generated materials.

2.2

Having a legal basis to process uploaded videos and audio files (own content, valid license, rights-holder permission, fair use under applicable law).

2.3

The content of uploaded material. Prohibited content includes (without limitation): child sexual abuse material (CSAM), incitement to violence, hate speech, fraud, defamation, illegal pornography, and any content that violates the laws of the User's country of residence or international norms.

2.4

Consequences of publishing, monetizing, or distributing Service-generated materials.

⚠ The Service does not verify the legal status of uploaded content and assumes no liability for User violations.

Content Sources

The Service supports exactly one content ingestion method:

3.1

Direct file upload through the web interface (user upload). The User uploads their own video and audio content.

🚫 Any other content acquisition method (including URL imports, pirate sites, unauthorized CDNs, file lockers, third-party hosting, or fetching content from third-party platforms) is prohibited and technically unsupported.

The User must download output files before the retention period expires. The Service is not liable for loss of files after deletion.

AI Generation and Inaccuracies

5.1

The Service uses AI models (OpenAI Whisper for transcription, GPT / DeepSeek for script generation, OpenAI TTS for voice synthesis) that may produce errors, including:

  • Misrecognition of names, terms, and proper nouns
  • Factual inaccuracies in generated scripts
  • Unnatural intonation in synthesized voice
  • Imprecise scene boundary detection
5.2

Generated content is provided "as is". The Service makes no warranty as to its fitness for any particular purpose.

5.3

The User is responsible for reviewing and editing generated content before publication.

Plans and Payment

6.1

Available plans: Free Trial (1 video), Burst ($29 — 30 videos, 30 days), Creator ($69/mo — 100 videos), Studio ($149/mo — 200 videos), and one-time packs: Pack 10 ($8.99), Pack 30 ($23.99).

6.2

Subscription payments are processed by Lemon Squeezy (Merchant of Record). Lemon Squeezy handles VAT, sales tax, and currency conversion.

6.3

Unused credits do not roll over to the next billing period unless explicitly stated for a specific plan.

Refund Policy

7.1

Subscription refunds are available within 7 calendar days of payment only in the following cases:

  • Confirmed technical non-functionality attributable to the Service
  • Billing errors (duplicate charge, charge for non-rendered service)
7.2

Refunds will NOT be issued if:

  • The User is dissatisfied with AI generation quality (see Section 5)
  • The User did not use credits within the billing period
  • The User's account was terminated for breach of Section 2 or 3
  • The User simply changed their mind
7.3

One-time video packs are non-refundable once credits are credited.

To request a refund, email airecap.support@gmail.com with your account email and transaction ID.

Limitation of Liability

8.1

The Service is provided "as is" and "as available", without warranties of any kind, express or implied.

8.2

The Service shall not be liable for:

  • Damages arising from the User's use or inability to use the Service
  • Actions of third parties (payment processors, hosting providers, AI model providers)
  • The content of uploaded or generated materials (see Section 2)
  • Loss of generated files after the retention period (see Section 4)
8.3

Maximum aggregate liability is limited to the amount paid by the User during the three (3) months preceding the claim.

8.4

Nothing in these Terms excludes liability that cannot be excluded under applicable law.

Account Termination

The Service may suspend or terminate any User account without refund in the following cases:

  • Breach of Section 2 (User responsibility)
  • Breach of Section 3 (Content sources)
  • Attempts to circumvent technical restrictions (reverse engineering, scraping, automated abuse)
  • Receipt of a valid DMCA notice or equivalent copyright complaint
  • Suspected payment fraud

The User may delete their account at any time via the dashboard or by emailing support.

Intellectual Property

10.1

The User retains all rights to their uploaded source videos.

10.2

The User retains rights to the generated recap files for their lawful use.

10.3

The Service retains all rights to the underlying software, models, pipeline, branding, and Website.

10.4

The Service may use aggregated, anonymized usage statistics for product improvement.

Changes to the Terms

The Service may update these Terms with at least 14 days' notice via email or in-product notification. Continued use of the Service after the effective date constitutes acceptance of the updated Terms. If the User does not agree, they must stop using the Service and may request account deletion.

12

Governing Law and Disputes

12.1

These Terms are governed by the laws of the Republic of Kazakhstan. The Service is operated by an individual based in Astana, Kazakhstan.

12.2

The parties shall attempt to resolve any dispute through good-faith negotiation for at least 30 days before initiating formal proceedings.

12.3

Any unresolved dispute shall be resolved through binding arbitration administered by the International Chamber of Commerce (ICC) under its then-current rules, unless prohibited by the User's local consumer protection law.

12.4

Nothing in this Section limits the User's right to bring claims in their local court for matters that cannot be subject to arbitration under the law of the User's country of residence.

By using the Service, the User confirms that they have read, understood, and accepted these Terms of Service.
